1. Acceptance of Terms

By creating an account or using AutoApply (the "Service") you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you ("User") and AutoApply ("we", "us", "our"). We may update these Terms from time to time; continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

AutoApply is a software-as-a-service platform that monitors WhatsApp groups you authorise, classifies hiring-related messages using AI, generates personalised job-application email proposals, and sends those applications via SMTP accounts you configure. The Service is provided on an "as is" and "as available" basis. Feature availability may vary by subscription tier. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Accounts

You must provide accurate and complete information when registering. You are responsible for maintaining the security of your password and for all activity that occurs under your account. You must notify us immediately of any unauthorised access or use of your account.

You must be at least 18 years old to use the Service. Accounts are non-transferable. Each account may only be used by a single individual unless you are on a Business plan that explicitly permits multi-seat usage.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation.
  • Send unsolicited bulk email or spam.
  • Misrepresent your identity or qualifications in applications.
  • Monitor WhatsApp groups without the knowledge or consent required by applicable law.
  • Reverse-engineer, scrape, or copy the Service or its outputs for competing products.
  • Interfere with the integrity or performance of the Service or its underlying infrastructure.
  • Circumvent any access controls, rate limits, or security measures.

We reserve the right to suspend or terminate accounts that violate this Acceptable Use policy without prior notice.

5. WhatsApp & Third-Party Integration Risk

AutoApply connects to WhatsApp using an unofficial, third-party library (Baileys) that is not affiliated with, endorsed by, or sanctioned by WhatsApp Inc. or Meta Platforms Inc. Use of unofficial WhatsApp clients may violate WhatsApp's Terms of Service and could result in your WhatsApp account being temporarily or permanently suspended.

By connecting your WhatsApp account to the Service, you acknowledge and accept all associated risks, including but not limited to account suspension, loss of messages, and loss of group access. AutoApply v1 operates in read-only mode and will never send messages from your WhatsApp account; however, this does not eliminate risk entirely.

You are solely responsible for your use of the WhatsApp integration and for compliance with WhatsApp's own terms of service. AutoApply accepts no liability for any action taken by WhatsApp or Meta against your account.

6. Email Sending

You are responsible for all emails sent through the Service using your SMTP accounts. You must comply with all applicable anti-spam laws, including the CAN-SPAM Act (US), CASL (Canada), and similar legislation in your jurisdiction. You must only send applications to parties who have solicited or otherwise consented to receive them (e.g., by publicly posting a hiring request).

AutoApply is a sending tool; the content and recipients of emails are determined by your configuration. We are not liable for the delivery, non-delivery, or consequences of emails sent through the Service.

7. Subscriptions & Billing

Paid plans are billed monthly or annually in advance. All fees are non-refundable except where required by law. We may change pricing at any time with 30 days' notice. If you do not cancel before the next billing cycle, the new price applies.

Failure to pay may result in service degradation or account suspension. Overdue accounts may be terminated after a grace period of 14 days. You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular job application will result in a response or an engagement. AI-generated proposals are provided as drafts; you are responsible for reviewing content before it is sent in your name.

9. Limitation of Liability

To the maximum extent permitted by law, AutoApply and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, including but not limited to WhatsApp account suspension, missed job opportunities, or SMTP delivery failures. Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the total fees paid by you in the three months preceding the claim.

10. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your access at any time if we believe you have violated these Terms, applicable law, or the rights of third parties. Upon termination, your right to use the Service ceases immediately. Sections 5, 6, 8, 9, 11, and 12 survive termination.

11. Changes to Terms

We may revise these Terms at any time. We will provide at least 14 days' notice of material changes via email or an in-app banner before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the revised Terms. If you do not agree to revised Terms, you must stop using the Service and delete your account.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which AutoApply is incorporated, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in that jurisdiction, except where prohibited by applicable consumer-protection law.
